Leave Requirements
With the exception of military caregiver leave, FMLA-eligible employees are entitled to a maximum of 12 workweeks of FMLA-qualifying leave during a 12-month period.
Example: John Doe works for an employer using the calendar year as its leave year. John Doe takes three weeks to care for his father in January. John Doe takes eight more weeks in May and June. John can take one more week before the end of the year if he is sick or has a qualifying reason, at which point he will have exhausted his 12-week FMLA allotment for the year.
